Family Law Encourages Family Harmony
Family ties are among the most private and enduring relationships in society, but some domestic issues cannot be solved within the home.
Family law is not just about divorce; it is about settling disagreements so the relatives can live in harmony or at least without dispute. An array of domestic issues such as these can be addressed:
Adoption
Since adoption poses many legal and bureaucratic complexities, a knowledgeable family law attorney can spare you of much of the delay, frustration and expense of an adoption. Are you a parent struggling to find the right home for a child? Maybe you want to welcome someone into your home. Perhaps you are hoping to assume responsibility for a minor in your family. Forefront Law, P.A can help so no detail is overlooked.
Child Custody
The dissolution of a partnership raises difficult issues, particularly when children are involved. We can review the child custody evaluator’s recommendations and explain how local and state laws impact your case. We will work with you to devise a child custody plan that works for everyone involved.
Child Support Agreement
Child support laws are different in each state, and it is important to understand the child support statutes and court decisions in Florida. A child support agreement has many facets. For example, if you are paying child support for a child who comes of age, how do you get the support payments that are taken out of your paycheck to stop? Do you want to set up a child support agreement? Does the custodial parent have to prove that the child support wasn’t paid? These and many other similar questions can be answered by Forefront Law, P.A.
Divorce
Divorce proceedings usually involve intense emotions and significant expense. Our goal throughout the divorce process is to minimize your emotional strain and cost. We handle complex contested and uncontested divorces.
If you and your spouse wish to keep your divorce proceeding private and away from the court, we will work with you, through voluntary mediation known as Alternative Dispute Resolution (ADR). During this process, both you and your spouse will meet with a neutral mediator to help resolve issues by mutual agreement. With ADR, there is complete disclosure and no litigation. Many prefer this method since it tends to be faster, less costly, and produces a more amicable outcome.
Domestic Violence
Domestic violence may include harassment, assault, sexual abuse and neglect. If you or someone you love has been physically or emotionally abused by a spouse or other relative, you should contact the police, then call us. We can inform the victim of his or her rights. We can obtain an Order of Protection from the court.
In the case of marital abuse, if the injured party wishes to pursue a legal separation or divorce in light of the events, we can advise the best steps to keep you safe and dissolve the marriage as fast as possible. We strive to provide you with peace of mind.
Should you require additional support beyond the legal realm, we can refer you to other resources to address all of your needs and begin the healing process. It is essential that you surround yourself with trusted advisers and friends. We provide the legal and emotional support needed to get you back on your feet.
Marital Agreements
We often draft prenuptial and post-nuptial agreements for adults who are either contemplating marriage or who are already married. Marital agreements are also used when married parties wish to enter into contracts that specify what the surviving party will receive if the spouse passes away. Often, such agreements promote harmony, especially when the parties have been married before and have children and accumulated property from prior marriages that they wish to protect and control.
Under Florida law, these agreements must meet strict rules and requirements to be valid for protecting assets in the case a marriage ends – whether by death, divorce, annulment, or legal separation.
Paternity
When the identity of the biological father is in question, a paternity action may be necessary to determine paternity rights, child custody or child support. In this instance, the court will order a genetic test and use the results to establish a legal relationship between the parent and child and to determine the extent to which the father has an obligation to support the child.
Even if the biological father does not wish to play an active role in the child’s upbringing, he still has an obligation to provide financial support to the minor. We offer legal services in filing paternity suits with the appropriate court and/or defending against a paternity action.
